The global impact of the pandemic, social unrest, and geopolitical conflict, compounded with the climate crisis and the demand for equity, equality, and transparency within corporations and institutions, continue to accelerate the calls to significantly address ESG - Law firms must respond, not only by serving clients but also by ensuring their own ESG house is in order.
These demands are increasing at an exponential rate.
Today's law firm leaders need to understand the obligations they face and the opportunities ESG presents. Internal processes and cultures of siloed action committees need to be broken down and reimagined. ESG-related initiatives must evolve from “nice to have” selling points on the firm’s websites to robust, effective ESG programs that are measurable and accountable to stakeholders.
To address these ESG challenges, a paradigm shift must take place.

Global and Climate Risks: Navigating ESG Amid Converging Crises
A growing number of professional services firms provide Environmental, Social and Governance (ESG) advisory services, including legal analyses of what disclosures to make to shareholders, regulators, and other stakeholders, and legal guidance on what actions might be undertaken to mitigate risks, from human rights in the supply chain, to geopolitical and climate risks to supply chains, to cataloging environmental pollutants, including carbon emissions.
Unfortunately, reporting on ESG risks from regulatory or compliance perspectives is not the same as positioning businesses to protect assets and revenue streams. As a consequence, a wide range of professional services firms, including law firms, are not proactively advising clients on the implications of the unprecedented buildup of risk as the climate crisis unfolds alongside interrelated converging crises—from geopolitical conflict, to political and social divisions, to environmental and climate change, to population health issues, and biodiversity losses.
This “trusted advisory gap" will leave many clients unprepared for shocks that put entire businesses at risk. This illuminating, timely, not-to-miss presentation and panel session with The Converging Crises Consortium, or C3, brings together two former U.S government senior executives who provided authoritative advice to political, business, and scientific leaders on the actual state of global change and climate change, and the futurist who advised Baker McKenzie and its clients on global and climate risk.

Dynamic changes in ESG issues continue to have an impactful effect on corporate governance and fiduciary duty. Boards now must live with ESG considerations as a significant component of its oversight of risk management, corporate strategy, and regulatory compliance, as well as assessing performance and reporting progress. Transformational governance is not a new legal concept. It is a way of thinking and acting responsibly and in the best interests of a business with its long-term sustainability in mind. It recognizes that the society and environment in which businesses operate are assets on which they depend. It, therefore, dictates that businesses be mindful of and transparent and accountable for their ESG impacts. This approach to corporate responsibility and accountability dovetails with the directors’ fiduciary duties to the businesses they serve.
Lawyers are also bound by fiduciary responsibilities to act in the best interests of their clients. When that client is a business, advice and counsel must reflect the principles of
transformational governance for it to be in the best interest of the business’s long-term, sustainable health.
